Default Builders Discount Lost

We had a Design Team meeting set for later this year and had to to reschedule for the middle of next year. We are still within our contract requirements.

Our agent has informed us we will lose the 3.5% builders discount because we missed the original meeting. I am OK with that. The problem is we are also being told that if a new discount is available at the time of our meeting, we will not be eligible because we rescheduled.

This does not make any sense to me. Has anyone else encountered this?

Can you cancel the original contract and try again? I am uncomfortable with the way they handle this. If people are beating the door down to buy why punish someone when they have circumstances they can't control. Also never heard of signing a contract to buy a house without a firm price (extras included as they come up). But I guess it has worked for TV and it's their ball game.

The builders discount is not part of the contract. It was discussed verbally and we were provided with an E Mail discount certificate.

Well, there you go - if it's not in the contract than it's not! Now I'm really concerned about verbal promises and certificates being given. But like I said it's their ball game.

You can say that again! We put our deposit on our lot in April. Went over the cost of the designer we wanted and major options. We were told the price. In July, decided to book a design meeting although it was premature for us. I had a feeling that the 4% discount would be taken away and my intuition was right. In any event, I think the price of the house has increased now three times. We have our meeting Thanksgiving week. Seems our 3.5% discount will be gone by then but whatcha gonna do? I'm just glad that we'll be in TV soon!

We got this from our sales rep on Aug 3rd:

Change in Home Order Incentive:
You'll want to be sure your future Villagers know.... home orders beginning January 1st will receive a 3% discount on their total
purchase price of their home, homesite & enhancements (pools being the exception). Home orders already booked & remaining
openings available between now & October 31st will receive 4%. Those ordering between November 1st & December 31st will receive
3.5%.

It may have changed since but that is what I believe is still in effect. The order date is when you sign and pay the 20%.

I understand the discount changes based on the above dates. This is not the issue. The issue is that I am being told that if you reschedule your Design Team meeting, you will not get any discount, regardless of what is in effect for other people.

Here's what I was told they have certain things in motion based on that date, manpower and materiel.

When the date is canceled you are paying a penalty, so if you use a home value of say 200K with a 3% discount, it may be better to lose the $2500 deposit and start a new lot contract.

You would be ahead $3500.

But I really think if someone else took that date you should be relived of the penalty.
