The OP told the cashier that they could not tax a gift card, but the cashier did not offer to make a correction. Instead, he made up some bogus claim that it was an activation fee. The OP was absolutely correct, and it clearly says so on the Florida state website. Business owners know what they can and cannot tax. I am not a business owner, but even I know that gift cards are not taxable.
My pet peeve is store has buy one get one and insists on collecting tax on both.

If the discount is applied at the moment of sale, they can only tax the actual sale price. Taxing an item not charged for would be illegal.

If the state does not investigate remittances how would they get into trouble?

If someone reports them to the state, they may do an audit.

So, just what is the tax rate on "FREE"?
Although, presumably, the store paid tax on it and would like to get that back, somehow.

The store cannot keep any money they collect as a "sales tax". All of this money goes to the state and county. And, they cannot charge a tax on a product that they give away for free, like a "buy one get one free". The free one cannot be taxed.

Actually do not think they paid a sales tax as they bought it for resale so they would just pay when they sell the product.
