I don't see the problem being on private property BUT what do the visitors do after this little gathering?? Do they sleep in the car to sober up before leaving? This is a little strange. Sounds like you need to invest on upgrading your patio.

but seriously key in ignition might be cause for some Barney to attempt a citizens arrest, unless benz is jacked up on blocks in the front yard like we do in sweet home Alabama

VILLAGETINKER, even if this person did do exactly what he said & had no keys to listen to the radio. Don't you think this very strange? If you have key in ignition, you ABSOLUTELY can be arrested if consuming alcohol. Why not be like adults and go inside? Sit in Mercedes? What age are you? Sounds like 14.

Default Consuming Alcohol in Car in a Driveway

Open container laws can vary from state to state, and in Florida, from county to county. However, the rules are pretty specific - with the exception of a motor home, alcohol may not be consumed in a motor vehicle, no matter where it is parked. Having the motor running is even worse, as this amounts to having physical control of a motor vehicle while consuming alcohol, which could result in arrest, and points on the operators license if convicted. Here's the Florida statute on the subject: Statute 316.1936
