See Post No. 93. That is a legal opinion from an attorney who actually practices law in Florida. I don't think the statute you referred to even addresses golf balls. A statute alone doesn't define the law. You need to consider all potential situations and the common law in conjunction with the statute.

And not one lawsuit was not the responsibility of the person that did the damage, i do agree there are cases that a judge may have not awarded the damages to the person suffering the damage. Like i said this is becoming exhausting lol... |

Again, I don't have a dog in this fight---I've never even come close to hitting a house. But the reverse is also true, someday the homeowner may come across the wrong golfer and........

You better reread statue 8:10 you don't have to post signs but it does help to make the ignorant aware or the declination line, is that's why the golf course puts wooden stakes all over the place, more golfers are not supposed to be in part of the course but do they ever pay attention, I see freaking idiots are even into water areas where Gators are for a ball really come on folk's!!!!!!!

There is no Florida law that states a golfer can retrieve an errant golf ball from a homeowner's property. A law firm who supports this so-called right will have to battle in court.

No. There is no Florida statute that gives golfers a general legal right to enter private residential property to retrieve a golf ball. Florida’s general trespass law (Fla. Stat. § 810.09) applies: entering someone’s property without authorization, license, or invitation can be trespass (a misdemeanor). Retrieving your own golf ball does not create an automatic exception under the criminal statutes. In The VillagesOfficial Villages / DistrictGov golf etiquette is clear and stricter: Do not enter residential yards to retrieve balls. If the ball lands on private property, treat it as out of bounds and play a new one. Playing beyond the property line of residential homes is strictly prohibited (even if not marked by out-of-bounds stakes). So in The Villages, course rules prohibit retrieval from homeowners’ yards regardless of the broader Florida golf-community practice. Thank goodness there are no house properties adjacent to pickleball courts as balls can sometimes leap over the tall fences around the courts. |
