It is legal, but whoever owns the course that the pond is on also owns the rights to salvage the balls. So typically they contract those rights out to a diver.

Now, the wet "environmental" areas on some of the courses, I'm not sure they can do that. I have often wondered about it, because I was under the impression that keeping people out of the environmental areas was some part of an agreement that the golf course developers made with environmental authorities as part of their responsibility towards the environment. I am not at all sure what that would entail.

Some of those environmental areas are literally a carpet of golf balls, so I can't imagine that's all that effective at keeping the areas free from the impact of golfers. It would make more sense to me to have them fished out now and then.
