The law suit is a red herring. A Developer cannot sue to force a local governing body to change a commercial zoning into a residential zoning just to please the Developer. Just because they own the property is irrelevant. That's why there are zoning laws.

They can’t legally force a change of mind, but they can challenge the legality of their decision and attempt to have the courts overturn it based on interpretation of the zoning laws. More importantly, they can turn it into a war of financial attrition and force the other party to roll over.

We have a great Town Square in Spanish Springs! You’ve no idea how good we got it. So get your heads out of your butts, support the businesses and events in the Square, and enjoy it!
