He knows that she would go to trial, and get off and/or be pardoned by Obambie. She would get the sympathy vote because of the big meanie Republicans beating up on the old granny. When Trump gets elected, there will be an indictment of Hillary and it will be too late for Obamabie to pardon her. He can't pardon her for something she hasn't been indicted for yet. On top of that, because he did not recommend indictment, everyone is now in an uproar about miscarriage of justice and that will animate them to come out and vote for Trump out of revenge. So, any way you look at it, it is a win-win situation.

Trump gets away with it. The meaner Hillary gets, the worst her ratings get. The recent evil comment by PokaNOTus, didn't help their cause any. I even heard Democrat pundits criticize her statement.
