This store has a record of RIPPING CUSTOMERS off, and KEEPS getting away with it. Well he Scrued the wrong GUY i wont to take ACTION .Every time i mention the store name, everyone go,s Oh no PAYNES FURITURE OUTLET!!! If anyone can recamened a CIVAL ATTORNEY OR ANY ATTORNEY THAT WILL TALK MY CASE!!! PLEASE CALL RICH At 440-897-6915

You can sue for up to $8000 in Sumter County small claims court. You don’t need an attorney for that.

You can probably even file your case online.

Are your damages within that limit?

I would try to avoid the spelling errors and all caps text in your letter of complaint.

You can also contact Seniors Against Crime for additional advice on how to handle this.

Not to be nit picky, but the name is "seniors vs crime", not "seniors against crime".

I’m using “seniors vs crime” to help me with Paynes. He seems to respect the person there unlike how he treated me.

Problem with small claims is that they won’t enforce collection so if you win and he still ignores you ….

Document all your dealings with him.

A little more info as to what happened would be appreciated to understand your situation. A couple of years ago we purchased a bedroom set from Payne's and they delivered the wrong box spring (no one wants to have to actually jump to get into bed). Called and came out and replaced it a couple of days later. So no issues with them. Just curious as to your dealings with them.

Had nightmare experience with City Furniture. Had to pay 100% to do a special order for 3 rooms of furniture. Took forever, but finally 16 weeks later they delivered.... THE WRONG FURNITURE. Then, they REFUSED to remove it and take it back to bring correct order. The delivery people actually tried to threaten us into signing the delivery papers, we refused. Seniors vrs. Crime has no legal power, but we reported it so they would have a record... turns out they had a LONG list of complaints. BBB was no help of course, they are very retail business oriented. Called the Florida attorney general's consumer affairs department and went through that process, it took over 18 months but they forced them to pick up all the furniture that was clearly NOT the style and brand we ordered (much of which we had to store in the garage all that time and leave our vehicles out !), and we finally over a year and a half later, got all the correct furniture we had ordered. I suppose we could have had a law suit due to all the time they had the over $15,000 we had to pay upfront to order, but we were just so happy to have the furniture we ordered and the nightmare over...plus the use of our garage again ! Good luck. Advice, stay calm, communicate in a civil manner don't let your anger get the best of you (easy to do in situations like this), and I think you'll find the Florida attorney general's staff very accommodating and "on the ball". In our case, they told us it was going to take some time because they had such a large numbers of complaints against the business we were dealing with.

I went to seniors vs crime and he still ignored my request to refund a purchase that occurred over 1 year ago and he never delivered.

He requested a 35% restocking fee for items he never delivered.

The seniors versus crime sumpter office has logged 15 complaints of a similar nature since 2022.

Problem with small claims court is that even if you win they don’t enforce the judgement.

Collection in small claims can be hard. When I won a case against Wildwood Kitchen and Bath, waited 60 days and had not been paid, sent the a demand letter, still no money, and finely had to file a judgement lien. That got his attention and was paid the next day, one day before I was going to start collection on property. Fun, Fun, Fun.

From my experience, most attorneys won’t take cases where the damages are not that large.

What are your damages?

Not sure but I do feel that small claims is for 15K and less and agree

The only furniture we bought new were our LaZ-Boy recliners, 30 years ago, our SleepNumber bed, 8 years ago, and our futon, 6 years ago. Everything else is either vintage, antique, or re-purposed stuff from spouse's workplace after they shut the department down and told everyone to take whatever would fit in their cars.

LaZBoy we had no problem with at all. SleepNumber delivered on time, and without incident. The futon was sort of a nightmare. Got it online, it's beautiful and we love it. But they insisted that someone had to be home when it was freight-delivered, and we weren't going to be in Florida that day. So they insisted also that it was light-weight enough to pick up, and would fit just fine in a pickup truck so we could bring it down ourselves our next trip down.

The mattress weighed over 100 pounds and stuck out the back of the pickup truck, and the unassembled frame weighed 50 pounds and took up a significant chunk of the rest of the pickup truck. So we had to make a trip down to Florida JUST to get the futon down there. And - it was delivered to my house in the north, while I was NOT home, and they didn't require a signature like they insisted they did when I'd placed the order. So we wasted around $500 in travel expenses - gas, tolls, an overnight in a hotel in each direction, and almost 3 days of time, just to get our brand new futon to our new home.

Everything else we picked up at estate sales, yard sales, flea markets, and even on the side of the road (a hassock with a hinged top that reveals storage space, that goes PERFECTLY with the rest of the living room furniture). A few pieces were inherited from family members, including a small bookcase made by my great-great uncle in the 1800s.
