Cologal, employers are only required to have prospective employees fill out a Form I9 Identification Form. If someone provides false/fake identification documents, how is the employer suppose to know that? I'm not saying employers are faultless, I'm just asking you to consider the entire hiring process for any employer, small to large corportation.
If an investigation by the ICE gets to a point that an employer is discovered to have hired illegals, let's prosecute the illegals if they falsified identification documents. Prosecute the employer if they don't have the legally required I9 paperwork. The DOJ isn't challenging the law that Arizona passed. They can't do that because the Arizona law is the federal law that isn't being enforced. They are challenging Arizona's right to enforce a law that is federal responsibility through the Commerce Act. How ludicrious is that? In the mean time, if the feds aren't going to enforce the immigration laws, I think Arizona has every right to enforce the same law. How can you expect the feds to come up with a tamper proof ID card when they can't come up tamper proof immigration system. The federal government's E-Verify is a flop. It has been shown to clear illegal workers 54 percent of the time. |

I heard a lot about the Commerce Act during the recent Kagen hearing. It seems that Congress does have some latitude or was the Central Goverment. Anyway...I think that it is legal for the DOJ to file suit on this. So the rule of law must apply. If you read my post I am pretty right of center on this but we do need a National ID.... and a Central Database for employers to verify the SS#. How lame is the paper card we get now? |

The E-Verify is the central data base now and it is very flawed. You and I both know that some employers look the other way and even pay cash. You aren't going to stop that completely with any system. I do believe the majority of employers do due deligence in trying to follow the law. Do you verify the legal status or take out taxes on your lawn guy, handy man, babysitter, pool man...
The immigration issue goes beyond employers and employees. Let's face facts. A sweeping amnesty bill would break this country. I'll say this and it may surprise you. I think Arizona has every right to protect their borders. On the other hand, I know why illegals, and I don't mean the drug cartel, just every day normal people, risk their lives to come here. This country is great. It means freedom and everything that comes with it. The poorest of our poor are better off than the illegals who risk their lives to come here and they want what we have. I honestly don't have a problem with that. Most of them don't want to be Americans. They want to work and send money home. As long as they don't get caught up in our hand-out welfare system, that is fine by me. The problem is, so many bleeding hearts think that by offering them a hand-out, it is a hand-up and it really isn't. The free enterprise system works. Let it alone. But off course people have to have fantasies of them being abused and used and get the unions involved. Please, if they can cross the border and make it this far, they can take care of themselves with a dishonest employer exploiting them. It's more money than many people in their countries will see in a lifetime. You may not like it but it is the truth. I know there are exceptions to every rule. If you want the privileges of America without the lower than minimum wages or exploitations that come with being an illegal worker, come to America the right way and do it legally. |

I still think AZ should counter-sue DC for dereliction of duty. AZ can rescind their law when DC starts doing it's job.

Thanks islandgal. Why is it he so easy to understand? To the point. Nothing hidden. If you break the law, you are going to be arrested.
Oh, and I've heard that Judge Susan Bolton has blocked some parts of the Arizona immigration law until the court can review the legal arguments. |

My theory is that the illegals are paying into Social Security and keeping it afloat and they won't collect on it so the powers that be in DC have kept their mouths shut.

The Social Security Administration has a fund called the Earnings Suspense File. It was set up as a place for Social Security earnings reports from people with mismatched SS numbers and names.
The agents in this department are suppose to track down the person or employer and straighten out the problem. Examples would be someone who got married and didn't register their names, misspelled names or someone using a false identity or beneficiares who die etc. This fund accrues money at a rate of approximately $6 billion a year according to the Congressional Budget Office. In 2004, the ESF reported 250 million records. The surge in the fund came after the 1986 Immigration Reform and Control Act. This law requires employers demand identification before hiring workers.
