For well over a year the question has been asked but never answered:

What insurance can someone obtain to protect them if they allow a renter to use their golf cart and there is an accident?

As of late it is still assumed that if your cart is used in any way as part of a rental or lease arrangement, liability waivers are ineffective, your auto and homeowner policies do not apply, and umbrella liability will be denied.

Anyone find a way out of this yet?

(I respectfully request that respondents refrain from replying that I should simply never let anyone use my golf cart.)

I have answered this before. Since we all agree that the auto insurance is not available, it is excluded on the homeowners policy, the umbrella only pays the excess of the primary insurance, which in this case there is none, there is no covereage and there is none availabe at this time. Therefore, do not rent your golf car with the house or you could lose everything you have worked for all of your life.

Yes, the perfect logical answer to your question is to call some insurance agents. IF there is some policy, they will tell you. IF there is not some policy, they will tell you. I would definitely rely on the persons whose occupation it is to know rather than ask a forum for their viewpoints who are not the experts (albeit very well-meaning people).

Remember, trying to find a loophole may make you feel good but IF a liability situation should occur, the insurance company WILL do everything in their power to show that loophole does not apply.

If its an absolute requirement to rent out your home with a golf cart....do not rent yours but provide an allowance in the rental agreement and have a prior arrangement made with a company or person that rents out golf carts. Your are then out of the golf cart rental business.
That said the question arises where do you put your golf cart when your home is being rented out and the renter wants to get a golf cart. They need a place to put it! Maybe you have some good neighbors or friends where you can put "your" cart while they are up north .... things start to get complicated fast!!

You might think about selling your cart to your renter under a separate agreement and the nbuy it back at the end of the rental period. Let the Renter get insurance on his own cart.

Have researched this in great depth. Called several insurance co. and they all say the same thing, they will not provide coverage on a golf cart that is being rented out with the rental house. You can sell your cart to the renter and then let them get insurance but that is a major hassle for the renter and may still leave you having to defend yourself in a lawsuit. Disclaimers and liabilitiy waivers may help but you could still be named in a lawsuit and spend thousands of dollars defending yourself and may or may not loose your "ass"ets. Even the golf cart rental companies do not offer insurance of any kind. They make the person renting sign a waiver but they (the ins. co.) can not get insurance specifally that indemnefies them either. Their overall business insurance, if they have any, may offer them some protection, but they could still be sued and possibly lose. The bottom line is who ever has the deepest pockets is who the lawyers come after first then they work their way down the food chain. No good definitive answer to this predictiment in my opinion. "Lawyers are worthless untill you need a good one". Unknown.

I don't think that is true. I just spoke to Scott from Grandma and Grandpas yesterday about renting to renters. I wanted to know if I should rent the cart for the renters, and he said they should rent it themselves, sign papers themselves, that way I am out of it. They are not insured carts...

Here is the standard that Allstate Ins. in Buffalo Ridge (4048 Wedgewood Lane) uses:

The client has been advised that the Bodily Injury (BI) liability coverage (only) will be excluded from the policy for any person or persons allowed to rent the golf cart that is under a contractual agreement. Such contractual agreement can be in the form or a property rental agreement or a contract to rent just the golf cart for a monetary payment (i.e. commercial venture).

However, if there is no contractual agreement in place, all coverage’s within the policy are extended to the renting party(s) including Bodily Injury (BI) liability under permissive use rule and subject to the driver(s) being properly licensed.

Please refer to Exclusion #14 - within the text or terms and conditions of your policy for further information.
