Now for that definitive answer:
You can only be ticketed by the police in your golf golf cart if you are on a public street. The multi-modal trails are NOT public streets. On public streets, the speed limit for non-street legal carts is 20 mph. |

If a trap is on a path and your going over 20 mph u may not get a speeding ticket but u can get an unregistered motor vehicle ticket. Whose going to argue with the officer and tell him he can't I've been passed on paths and my cart is legal 20MPH.

From the VCCDD Minutes:
Valerie Fuchs, District Counsel, advised the Board that Florida Statute Chapter 190 does not provide the District with law enforcement authority. Ms. Fuchs stated jurisdiction for law enforcement of the streets, highways and roads is vested within the counties or cities in which the roads lie, which for District 3 is held by the Sumter County Sheriff’s Office (SCSO). In response to the question raised whether the SCSO could assist the District by enforcing speeding violations that occur on the multimodal paths along Buena Vista Boulevard, Ms. Fuchs advised, because the multi-modal paths do not meet the definition under Florida Statute Chapter 316 as a road, street or highway, the SCSO has no jurisdiction to enforce violations on the multi-modal paths that exist on District property. Valerie Fuchs further stated the District cannot enter into an Interlocal Agreement with the SCSO to provide for the law enforcement of those multi-modal paths along Buena Vista Boulevard because the District does not have law enforcement ability to grant to the SCSO. Ms. Fuchs advised the District does have the authority to place control mechanisms such as speed bumps or humps along the multi-modal paths to control speed if it so chose to do so.

Work with the Sheriff to measure the cart speed on the path and wait for the cart to cross a county road. If I'm not mistaken the offense would still be driving an illegal cart on a county road. The district could just ban the driver or the cart from private property and ask the sheriff to assist with a trespass order. Publish the names and pictures in the Sun of the speeders. Ban speeders from the golf reservation system. If speed bumps are installed the only winners will be the cart towing and repair services. |
