Our neighbors who do not speak to anyone or take care of their yard or landscaping had a pool put in this summer.
Instead of putting the Port a John on their property more towards the front of their house, they put it right on the property line on the side that was directly in view of our front window and door. It remained there for two months in the hottest months of July and August. The smell was horrible. Every time we opened our front door or were out in our driveway, the smell was sickening. Most of the time the door was open and we had toilet paper blowing out on our front yard. Ewwww! Workers driving by would stop and use it as well as the construction crew working on the pool next door. I understand that the construction workers need a place to "go" but there should be rules on how close to
the property line that they can place them!

While Florida and Sumter County might have requirements for Portable Toilets at construction sites, the basic requirement is established by OSHA under 29 CFR 1926 (C) Sanitation at construction sites. There are requirements for the number, type and cleanliness and even for making sure there is TP and soap. I suspect also some access to water. There is also an exclusion for the need if there is a mobile crew. 29 CFR 1926 (c) (4). A mobile crew is one that is not there for days or weeks and can access facilities within 10 minutes.

That being the case , it would seem that if the facility has been there for months and no one is working , it would seem that it should be removed. That would save money for the contractor.

For me, if I were contracting for a home project, I would make the contractor establish that all his workers were a mobile crew and make sure they had mobile access to facilities rather than a Porta John in front of my house for months.

Note - lack of cleanliness is an OSHA violation.

Thanks to those of you who recognize the problem and don't try to make excuses for the horrible location and disgusting look. You would think that our Community Standards would do something and that is a big disapointment. It is interesting that some input to this thread are from intelligent readers who have identified some solutions through OSHA or sections of the law that would fix the problem. However the Community Standards Dept. are lost in finding a solution and enforcing a resolution. I am dismayed at any who look for reasons to allow the intrusion of this eye sore?
