This guy no doubt stepped over the line big time and has a serious problem. That being said, I think the Morse family has to share some of the responsibility for not enforcing the "no saving chairs rule". Not enforcing the rules is the same as condoning the action.

I spoke to one of the "event" people stationed at the SS square. It did happen on Monday night, when Rocky and the Rollers were playing.
1. He informed me there is a no seat saving policy,as we all know. 2. When the bands starts, they make an announcement saying there is no seat saving. One is within their rights to remove the cushion and sit down, as the seats themselves belong to TV. Obliviously, the person saving the seat will give you an argument. 3. Before one is arrested, the police give them a lot of options. It doesn't happen instantaneously. Obliviously, this guy and has a problem and it will cost him monetarily, along with the embarrassment of being arrested. I hope for his sake, he will ponder, "was it worth getting into this much trouble?". Remember my rule, "one fanny in seat = reserved". If seeing R&R was so important, they should have made it their business to arrive on time.

be careful about litigation. Chatbrat is correct in that damages can only be awarded for the cost of injury and losses. Her pain and suffering were minimal if accurately reported. She could claim emotional injury, fear, anxiety... harder to collect. The deep pocket here is the Morse family and its subsidiaries who have created a situation which resulted in this event. There has been a myriad of similar events, online threads about how enforcement was needed and nothing was being done by the "authorities" and that someone was going eventually to get hurt. With this notification of a hazardous situation and no attempt being made to resolve it, you may be entering the area of Morse et al being a defendant and potential punitive damages. Look how much Hulk Hogan got for having his feelings hurt (complex case).
If there were a successful lawsuit or even concern of such a suit, I would suspect the end of free entertainment on the squares would be the response. Still want her to get a good lawyer? |

Is there a sign at the Squares regarding saving seats? I missed it---I guess---but haven't been there much this past winter. What does it say and where?

You don't have to watch Judge Judy to know that you can NOT put your hands on another person. Period. There are other avenues to solve the problem. Seat-saving is prohibited, so the angry bird is the violator, not the victim. I personally don't see a problem with saving a seat for a friend who's parking the car or golf cart, or even up to 4, including my seat, when 2 couples go to the square together. That makes sense. But crime scene tape across 8 or 12 seats is ridiculous. I know some have mobility problems, but everyone who is not so handicapped should be willing to show up at the same time. First come, first served works well in most cases. But I am willing to allow 4 seats, MAXIMUM, but only if 2 couples are going together. Common sense and anger management are the issues here. And violence is NOT acceptable. Filing a criminal complaint would be a good idea to deter other hotheads from doing likewise. "Standing my ground"? Really? Maybe next time he could "stand his ground" against a 4-year-old. That should make really proud of himself. Idiot!

How? How exactly? These are rules not laws. Police can't enforce no seat saving, just if someone gets physical. The squares are open to the public so you can't de-card people who don't live here. You could have someone pick up and remove all stuff I guess and be prepared that someone who had a lot of wine with dinner might make a huge fuss and hit someone. I like the kind of sign that Just Jim suggested, but there are some folks who think they can do anything they damn well please anytime.
Tell me exactly how, Walter, how the developer could resolve it easily?

I wonder if you agree with looney or just want to disagree with me. I think the latter. If Looney's logic is correct then why do police give speeding tickets, after all, there are speed limit signs that anybody driving can read.
The developer created this situation as blueash said. Take their cushions, ropes, coolers and any other crap that morons use to save seats and trash them. Don't even give them the opportunity to get them back. Put up a sign that that's what will happen to CYA and get on with it. Classify it as litter. If this is not done then the rule breakers win and the mild mannered villages will lose. PB, you and your posse could handle this easily. |
