Default Do I need an attorney as a CA$H buyer ?

If so any recommendations? What is the general cost? It would be a cash purchase. Gotta be cheaper than up here in NJ!

Yea, there is tile insurance up here in NJ as well. We never took it up here (that was back in 1972) but our buyer is taking it.

Thanks. Can't wait to get down there and start looking. 3 weeks from tomorrow.

This no lawyer thing is a new concept thing to us. We don't make a move without lawyering up. BUT, to me it just felt ok to do it here after extensive investigation. Let your conscience be your guide. Nobody can give you a green light on this one but you. I sent my contract to my NJ lawyer for a quick look and even though he isn't licensed down here here said it was a go. Use a NJ bank that has a branch down here because you can't bring a Certified check to closing, the title company said they preferred to work with a local bank and the money was wire transferred to the closing.

Boomer knows more than I do about the way things work down here so that advice may be better. I did want to help Ed not mess you up. 3 weeks. In the blink of an eye.

If buying a preowned home through MLS, the seller will normally pick the title co. since he is (usually) providing the title insurance. We recently closed a sale with Freedom Title & Escrow Co., LLC, 133 S. Old Dixie Highway, Lady Lake, FL 32159. 352-633-5195 and found them to be very efficient.

Yea, we got Wells Fargo. They keep our money in their stage coach!

We bought new homes here twice, cash.. First time in our lives we opted not to get title insurance. That was on advice from folks we know well who are as careful with their money as we are.

I would never buy a used home without title insurance but we have bought several homes in Ohio and never used an attorney. Different ways and different views and rules in different states and your own personal decisions.

The problem you have is making sure you have clear title to the property. Not sure that an attorney would do that. He would probably only review the papers you are signing so if you hire one make sure the attorney is verifying the title.
To be sure about the title then you would want title insurance. The title company will verify the chain of titles to the property and also insure you if they make a mistake.
Make sure that your agreement of sale lets you cancel if you find x $'s in repairs, title is bad etc. The attorney would help in this area.

My suggestion re purchasing a pre-owned home is that you pass on hiring an attorney and just be sure to have a good Title Company and Title Insurance; the title company will conduct our closing and provide you with all paperwork. Beyond that I also suggest that if you a re purchasing a pre-owned home which includes any furnishings/appliances - and you want to keep any of that furniture/appliances - please take photos of all pieces that are included in the sale. Friends of ours arrived at their walk-thru prior to closing on their pre-owned only to find out that the owner had swapped out the new refrigerator that had been in the home for a much older and more used refrigerator! Friends said they were not closing unless the situation was corrected; and they held to that, despite the sales people's disbelief! Resolution was that the two real estate sales folks kicked in the cash for an 'appliance adjustment' amount that was satisfactory to our friends...the owner was having nothing to do with her misdirection!

We purchased cash from FSBO and we all used Mc Lin & Burnsed in Lake Sumpter Landing.
