I would think you would need a Florida Liquor Liscense and all the Florida State Liquor tax paid. Otherwise, it may be "bootlegging ".

Just going by your question, yes you need a license to sell package liquor, which is not the same as a license for consumption on premises (COP License). A liquor license in Florida is a quota license, meaning they are limited to the number of people in the county. I believe in 1939 Florida stopped issuing liquor licenses. They will issue a new license whenever the population increases by 7,500 in that county. For this reason, liquor licenses are real property and are an inheritable item and to purchase a license you must submit to a lottery for a license when it comes available and the price can be anywhere from $50,000 to $750,000 depending on the demand. There is also a state activation fee which I believe is about $10,000. I remember many years ago when living in St. Petersburg, Albertson's was the first grocery chain that started having a package stores located at the grocery store, this is in the early 70's. They opened their first location in downtown St. Petersburg in 1975 and needed the license badly since they didn't want to wait on opening the package store later. They paid $300,000, which was a lot in the mid 70's. That's when I first learned about the quota system. |

Do you mean one of those display ads that run down the border of the website? I don't see those since I use Google Chrome browser with the extension 'Fair AdBlocker', which eliminates all of those ads. However, if it's in the Villages Items for Sale section, then you can provide a link. Also the rules of this website say they must be a Village resident.

I wouldn't think so. I think those guys from the Bureau of Alcohol Tobacco and Firearms would think that was a big 'ole no no. I am not a lawyer but we can't seem to keep them out of our family.

![]() ![]() That is no different than buying ten cartons of cigarettes in North carolina for $10 a carton and selling them for $30 a carton in Florida. On the liquor bottle, just like on a pack of cigarettes, there should be a state seal where tax was paid. Crossing state lines to resell will get you in trouble when caught. I'm sure the administrators of this website have in the listing agreement wording about selling illegal items, such as fireworks, alcohol, etc. I've never sold anything on here, probably a box they had to check. If this advertiser had listed these as rare and out of print purchased in the 80's, maybe they could fall under a collector exemption. However, they say they are still available to the public, but only in Tennessee. That's like Havana Cigars, collectiable but illegal to resale. |

But seriously, I doubt that the liquor authorities would be concerned about a few bottles. Tax stamps on bottles went away back in the 70's. The person probably bought a few bottles at the distillery and paid the appropriate state tax there. Selling or advertising liquor on this site might technically be illegal but selling anything through ToTV classified and not collecting sales and submitting tax is also bending the laws. An often herein mentioned TV resident trait perhaps? |
