Just a suggestion get a property survey.

I am sure they too submitted a survey or plot plan. It is not that expensive, and worth all your trouble, and good to know. You will be very surprised at the true property lines. A lot of people assume but this should clear up everything. Also, find out HOw Close to your property line, they can go before they can start Landscape. Usually, it is 2' away from your property line. Also, there is NO LYING to the committee... its all about legal paperwork...
Actually, there was lying during the hearing. She also drew out the hard scaping to make it look like it didn’t go over the property line. They bought it and approved it. And BTW - her drawing didn’t show how much space there was between the hard scaping and property line. When I submitted my own landscaping for approval, it got denied at first because I did not show these measurements. Double standard, not following their own rules

She knows. I filed the complaint in July. She lied in the hearing at which I was not notified of it’s existence.

I’d hire an attorney if the neighbor is encroaching and refuses to repair encroachment and would also sue for recovery of attorney fees.
Exactly!!!

I received the survey when I closed this new house. There is no doubt at all about the fact that she lied to the ARC and drew what was convenient to her to have it approved.

This is hard scaping, not just landscaping. It is intruding onto my property. Ever hear of squatter’s rights?

Default Landscaping woes

Pictures are worth 1000 words. Take pics of the area in question when you have your sprinklers on. Then find out when their sprinklers are on and take pics. Be sure to capture your house in the pics. If your water is watering their landscape then you have proof to send to the ARC. There are many ways to dispute but this may be the least expensive.

Your neighbor planted something that you, too, get to to enjoy. Maybe you might thank them? Just a thought.
Who is responsible for watering, fertilizing and trimming the landscape; (maintenance)? Would that be the person who planted the landscape or the person who's property contains the landscape? Just wondering.

EDIT: After reading the thread further, I realize now this is hardscape, not landscape.

Re your issue, have you spoken to the neighbor? What was their reply? If they are not willing to remedy the error than you have are pretty much forced to push the issue. As stated, fl law requires you to address the situation.
