Hi GE.....Yes, I do consider a person an obstacle. I would never endanger a pedestrian and would always avoid them at all costs. That is not to say all drivers would do that. They could be impaired in some way. That is why I continue to impress that walkers should always yield to vehicles that could injure or kill them.

Do pedestrians have the right of way on a cart path that is adjacent to a roadway (such as Odell Circle)?
You won't find such a link. The MMP is a private road on private property and not subject to traffic laws.

The "cart path" is a designated section of the roadway. Pedestrians in the roadway and much of what has been discussed in this thread are covered by section 316 of the Florida statutes. In particular, see the specific paragraphs mentioned in previous posts.

One thing is abundantly clear, both in the traffic laws and criminal laws, you cannot use your golf cart as a weapon to injure a pedestrian. Playing chicken with a pedestrian, refusing to provide reasonable space when passing a pedestrian, intentionally hitting a pedestrian, or intentionally hitting anyone will usually turn out badly for you.

In villages most walkers seem to blunder along and have no clue of rules when walking.
None of those laws apply to MMPs, where cars, motorcycles, and trucks are not permitted at all.

If there's a sidewalk adjacent to the cart lane, then pedestrians should be walking on the sidewalk. That's why it exists. If there are too many of you to fit immediately beside each other, tough. Stagger your group. If a pedestrian is coming toward you, you'd have to stagger the group to let him pass anyway.

The cart lanes that don't have sidewalks next to them (like northern Morse Blvd), you'd need to have a death wish to walk on those. Or maybe you just want to see some poor golf cart driver have to veer out of the lane into traffic behind him to avoid hitting you, only to be hit by the car that wasn't expecting you to do that.

Most MMPs are wide enough to accommodate a golf cart and a pedestrian, without the golf cart needing to swing wide into the opposite direction's path.

Default Pedestrians

Pedestrians always have the right of way, but should be walking against traffic. It is a courtesy for pedestrians to step off the MMP if there is room. If a case were ever to go to a courtroom, a pedestrian would have the right of way against a motorized vehicle, No judge in their right mind would ever endorse a motorized vehicles right against any walker, whether they Cary a cane or are just walking.

Do you mean pedestrians always have the right of way on our MMPs and diamond lanes or in general? According this this article, pedestrians do not always have right of way but this is not concerning our MMPs and Diamond Lanes.......

I think on the MMP you'll be pretty safe from that scenario.

On the roadway you should be looking ahead, anticipating cars coming out of side streets. If you don't see any cars in a position to enter the roadway, you could very safely give the cart a little room. You don't even have to cross the yellow line. Just feel those little reflectors on your tires and you'll be giving the cart a touch of room.

Or, you could just be an inconsiderate jerk. Your call.

I take it you didn’t read part bout PRIVATE roads which MMP are. Now do I need to describe what road is or can you look that up?

I'm pretty sure you just insulted, pretty aggressively about 90% of us. Can't imagine that's working out too well for you in whatever community you live in. It ain't in mine.

I am not sure any of these posts have answered the OP's question regarding men vs women. Personally, I think that men are more courteous drivers than women.

I just read every word on that web page, of the post that I responded to. It's mostly about pedestrians on roads pertain to CROSSING the roads. There's verbiage about not being permitted to walk on the road if there's a sidewalk adjacent (to answer coffeebean's question about Odell). There's verbiage about cars and other human-powered vehicles needing to take due care to avoid hitting pedestrians.

I don't see anything that specifies "private roads" are treated in any special way. However, MMPs aren't roads. They're multi-modal paths. Cars, trucks, and motorcycles are not permitted on them at all, and so cars, trucks, and motorcycles don't have any laws regarding what they can and cannot do while driving on them, and there are no laws about what rights pedestrians do and don't have with regards to cars, trucks, and motorcycles driving on MMPs.

When you're talking about the law, terminology and definitions really do matter. MMPs aren't roads, private or otherwise.

A MMP is not a "roadway" , Multi Modal Path , pedestrian, pedalcyclist, golf cart limited to 20mph

I also never go over the center line when driving an automobile. That is dangerous. I will never understand why drivers move to the left of the center line when a golf cart is coming up on their right in the MMP. There is room for both of you unless you are driving a huge truck with a wide load.
Wouldn't you feel horrible if you hit a pedestrian and severly injured or killed them?

I will swing wide when I see pedestrians, however, I almost hit a walker just last week who insisted on walking on the MMP around a curve and hillside. I absolutely could not swerve to the left to avoid the man in the roadway because there was no line of sight for oncoming carts who might be going down that hill towards Colony. It seems you think putting yourself in jeopardy is a better idea than just moving to the grass in dangerous spots where carts would not be able to see you beforehand. I was inches away from hitting that man, and will not put myself in jeopardy by moving into an opposing lane when there is no line of sight of what is coming toward me because an idiot insists on his “right” to stay in the roadway. You walkers who insist on staying in the roadway with carts who have to navigate blind curves and hills only need to be hit one time to change your life forever.

Likewise, when I am driving the MMP, and I see a walker coming my way, I return the favor. It's just a courteous thing to do to let the pedestrian know he/she has been seen and will not be hit.

When I'm driving my car on a roadway with a cart lane, and there is no oncoming traffic, I give the cart a little extra room. Doesn't cost me a thing, and makes life a little more comfortable for the cart. And, heaven forbid, should the cart driver's attention waver a tad, the extra 2 feet may be a life saver.

I encourage you to try to be a little more courteous. It won't cost you a dime and may avoid an accident.
Thank you. That’s it exactly. I don’t have a need to be “right”, I have a need to be courteous and not hurt anyone. Makes it a good day for me.
